You lost me on the abortion issue, but that's probably a discussion for a different context. Suffice it to say, I am not sure what the state should be involved in legislating if it should not be involved in defining and legislating against murder.
Open Timestamps are an interesting example. I do think they technically qualify as spam in my definition, because they are storing data on the blockchain that is unrelated to Bitcoin's purpose as money. However, it is done in such a way that it is the least offensive form of spam, because the amount of data for each timestamp is so small, and the way it is saved does not bloat the UTXO set (making it much more difficult to run a node), and it is prunable.
