There's a pre-existing agreement in your scenario. Very different from hiring someone to hunt down that co-worker who didn't like your tie.
Expected harms are kind of necessary in the model to arrive at a liveable society. For example, dumping waste in the river isn't poisoning anyone directly but we both know what happens to the people downstream. Without that you leave room for lots of externalities that cause "indirect" harm.
