BREAKING: #ICE agents have, once again, trampled the 4th Amendment… illegally breaking down a door and storming into another family home with assault rifles drawn, while children were inside, detaining 6 people, including a 12-year-old boy, without a warrant.
And it gets worse.
On Thursday, ICE raided a home in St. Paul, #Minnesota, telling residents this was part of a narcotics investigation… not #immigration. But neighbors are saying that’s BS.
A neighbor who had his outdoor camera rolling, says someone delivered a package to the house just minutes before the raid. According to the video, federal agents told the residents there were drugs inside, and if no one claimed the package, they’d take everyone in the house. Not suspicious at all…
And the agents also had no warrant…
After smashing the door, ICE claimed they had a search warrant, but never showed it… even after being asked to see it. They searched every room with rifles drawn, handcuffed all residents, including the 12-year-old boy, and paraded them down the street. Every adult had a valid work permit and state ID, but, agents only left a woman and her infant behind.
And here’s the kicker:
Even though ICE said this was about drugs, not immigration, they still took the 12-year-old boy, transporting him to an immigration center in San Antonio, Texas in less than 24 hours.
And, to make this all even more illegal… A warrant was dropped off THE NEXT DAY, claiming to be from a state court, but:
• It doesn’t match official Ramsey County #warrant formats
• Has no case number or file stamp
• No record of filing exists (though filing can sometimes be delayed)
So, the questions become:
Did ICE falsify a warrant after illegally entering the home? Did they plant drugs to justify this raid? And most importantly… what did #DHS do with a 12-year-old boy they weren’t supposed to touch?
This isn’t law enforcement. This is federal #kidnapping, #trafficking, intimidation, and #terror.
A government agency stormed a home, handcuffed children, and transported a minor across state lines… all without a real warrant at the time of the arrest, or any legal justification.
If this can happen to one family in broad daylight, it can happen to anyone.
The #Constitution, your rights, and your #children mean nothing to them.

Got ripped off on an online purchase over the holidays for about $44.00
Sent dispute to bank/visa.
Bank disputes my dispute and rejects. Just got off the phone to learn the person who reviewed my dispute lied about the answers I provided in their dispute form as cause to reject the dispute.
Now, they've breached the state consumer protection act.
They're under threat of litigation if they don't return the money, which, is no idle threat.
Why would I go to these lengths over $44.00?
Because I'm SICK AND FUCKING TIRED of living in a #corporate dystopia and will drag the money out of them NO MATTER WHAT!!! Have fun paying your attorney's thousands of dollars over a $44.00 dispute because your corporate policy is to screw over your own clients to enrich your shareholders.

I predict Trump will lose his #House and #Senate majorities after the #midterms ... then they'll successfully impeach him.

The way to prevent business as usual is to PRIMARY the incumbent democrats.

#Capitalism would not exist without blind adherence to, at least, three fictions:
1. Legal Fiction: Ownership. Do we *really* own things? Or, are we just tenants as we pass through?
2. Political Fiction: Perfect competition. Capitalism can only perform as expected when monopoly is nonexistent. We ALL know this is never, ever, the case.
3. Scientific Fiction: Infinite Growth. Physics demands finite systems have finite thresholds. We act as if the earth is a perpetual cornucopia machine for the sole purpose of generating #YachtMoney.
We all know these points are axiomatic. And yet we continue to live the fictions.
It’s time we began living in reality.

I read a lot of science fiction. It fires my imagination and allows me quiet time to escape from the mundane worries of the world. But, unlike certain billionaires and apparently tons of scientists, I understand that "life" and "space" are antithetical.
We throw so much money, and so many resources at what amounts to an urban myth.
We don't; however, throw money and resources at colonizing vacuum based antigravity microwave ovens.
But that's a pretty close analogy to space.

Fuuuuuuck …
I don’t want to believe this, but I know deep in my bones it’s correct.
“Stupidity is a more dangerous enemy of the good than malice. One may protest against evil; it can be exposed and, if need be, prevented by use of force. Evil always carries within itself the germ of its own subversion in that it leaves behind in human beings at least a sense of unease. Against stupidity we are defenseless. Neither protests nor the use of force accomplish anything here; reasons fall on deaf ears; facts that contradict one’s prejudgment simply need not be believed – in such moments the stupid person even becomes critical – and when facts are irrefutable, they are just pushed aside as inconsequential, as incidental. In all this the stupid person, in contrast to the malicious one, is utterly self-satisfied and, being easily irritated, becomes dangerous by going on the attack. For that reason, greater caution is called for when dealing with a stupid person than with a malicious one. Never again will we try to persuade the stupid person with reasons, for it is senseless and dangerous.”
— Dietrich Bonhoeffer (murdered in prison by nazi’s)
So, how do we combat it? I suggest a firm understanding of Plato’s cave allegory. I was blown back by this article: https://thereader.mitpress.mit.edu/platos-cave-and-the-stubborn-persistence-of-ignorance/

This just pisses me off to no end. THIS is the head of google’s “Everyday Robot” division. You know … Mr. big brains Hans Peter Brondmo and all that???
What Mr. big brain is really saying is that we need all these robots (read: more natural resources we’re already running out of) to maintain THE CURRENT LEVEL OF #ECONOMIC GROWTH.
Which, anyone with a *small brain* knows is unsustainable.
No, it is not *imperative* that we squander further natural resources to maintain #Google shareholder value. It’s fucking stupid.
Less people = less services and products. It means less restaurants. It means less factories. It means less hospitals. It means more resources per capita and healthy functioning #planet.
It means, that in an age of climate crisis and resource wars that LESS IS MORE.
So, go fuck yourself Mr. *big brain.*

I already admitted I agreed with you upthread vex. Not defending it. Just sorting through the reality.
But, I can readily turn the tables and ask: where are you going with this? Identifying problems and posing solutions are two different things. I’ve never seen an anarchist argument that confronts it. It just breaks it down into smaller parts.
Did native American’s (the closest thing I’ve ever seen to anarchism systems in reality) use coercive control to maintain order? Can you name one society that hasn’t employed measures of coercive control?

2024-09-10 21:38:18 UTC

Not disagreeing. But, I will say law is a massive field. I'd say the argument applies strongly to, let's say, prosecutors. But, weakly to issues such as family law.
Perhaps, the argument's best utility is to serve as a knife to cut law apart and see in what amount coercive power applies along a legal spectrum.

I think the fundamental philosophical the writers of the constitution made was assuming an adversarial from of democracy, rather than a pluralistic form, was the best way to get to effective governance.
The U.S. was established as an adversarial democracy. The thought being, the constant fight winnows flabby political approaches to problems.
In hindsight, it looks like the theory behind a medieval champion. "Oh, look, you're dead. My side must have been correct."

2024-09-10 14:27:02 UTC

The existence of #conservative #lawyers will always baffle me.
Why, you ask?
Please allow me a bit to explain.
As foundation, there’s a lot of research out there demonstrating that conservatives, on average, are less cognitively complex than #liberals (now do studies on libs v. #Leftists).
It’s a #tribal thing that we’re all naturally born with. We are hardwired, through heuristic mental adaptations, to see the world in black and white terms.
Education and certain experiences teach us that the world really doesn’t work that way. It’s complex. It’s ambiguous. It’s a million shades of gray.
You don’t necessarily get that though through a STEM education. There, most of the time, there really are right and wrong answers to problems — black vs. white.
The liberal arts, to which the study of law belongs, are a different story. Ambiguity thrives and there are no right or wrong answers … only probabilities based on factual context.
Many law students struggle mightily with this concept. You learn quickly in law that there are no right or wrong answers. The talent lies in being able to cogently analyze the strengths and weaknesses in fact patterns and generate probable outcomes.
So, I wrap all the way back around. Lawyers are trained and judged on their ability to resist black and white thinking and generate nuanced probable outcomes.
I practice with a conservative lawyer. And, it’s amazing to see him do his thing in the court room, and then take his tie off and immediately revert back to his default black and white political thinking.
I guess some people just become inured to cognitive dissonance.

Anyone know of #research into the correlation between hours spent watching #TV, and superfluous personal #spending.
My brief search revealed nothing.
But, there’s a PhD waiting for someone if they do it.

Anyone happen to notice that the #Trump plan to #MAGA, is basically an inverse laundry list of things our constitutional founders thought would make #America great.
Things such as:
1. Separation of #Church and #State
2. #Freedom of Assembly
3. Pluralism — you know *E Pluribus Unum* (out of the many one) used to be our national motto until the #christofascists that Trump appeals to started chipping away and changed it to “In God We Trust” (if it’s a christian god).
4. Quartering of Soldiers on domestic land
5. Attempts to undermine due process, and
6. Arguably the 22nd amendment’s 2 term limitation as president.
Did I forget some?
MAGA … Make American Great for Authoritarians.

The **Overview Effect**???
I’m pretty sure nature didn’t want us blasting into space to realize this.
Which is why she provided us with rye ergot and psilocybin.
You’ll get to the same place.

#OpenAI is being sued on multiple fronts for #copyright infringement.
I don't know about you, but #lawyers around my neck of the woods call this an *admission.*
When you publicly *admit* the acts that form the basis of the cause of action (here copyright infringement) ... you typically lose.
Hey Sam ... you just lost. #Loser

Of course it's poor. That's why I posted it. The WaPo is owned by the TechBro in chief ... Bezos. The entire article is posed so as to make the regulators look to like the boogie men ... rather than the real bad actors ... the TechBros.

The corporations are the threat.
The internet is only a "threat" because the corporations enshittified it.
Yeah, looking at you ....Bezos. There's a story you'll never see in WaPo.
**“The pendulum has swung from public discourse being all about ‘internet as a tool for freedom’ to ‘internet as a threat,’” said Daphne Keller, director of the Program on Platform Regulation at Stanford University’s Cyber Policy Center and a former Google lawyer.**
Revenge of the regulator my ass. Do your fucking jobs.
