OPA did not sustain any excessive force complaints. The only sustained finding was that Officer Brian Muoio did not activate his bodycam and operated his bike unsafely.
He rammed someone head-on, knocking him down. Muoio was given a written reprimand.

Muoio was also given a "supervisor action" for unprofessionalism, which is unusual if the officer has repeatedly violated the same policy (Muoio has been investigated 8 times for this, 3 sustained).

Now that the consent decree is over, SPD is no longer following its own policy of releasing officers' names and video footage within 72 hours after a shooting.

There was zero justification for this. Per Graham v. Connor, force must be "necessary," meaning there is no "reasonably effective alternative," to achieve a "lawful purpose" (handcuffing)

A force trainer at the department told OPA that SPD doesn't train officers to push fleeing suspects like this ( because it doesn't train officers how to end foot pursuits. Period).

The force review board found that the action was outside of policy because Englund didn't consider the hazards in the store, which made the risk of injury high relative to the offense.
There were two other officers nearby, allowing for other options.

Englund's chain of command rubber-stamped his force, so the issue wasn't found until the force review.

The guy has no open warrants, and there's no probable cause, so Englund cuts him loose. OPA faults Englund for exceeding the scope of a Terry stop, illegally searching under the pretext of a frisk, and frisking with no safety concern.
He's suspended for two days.

After finding what he's looking for — a plain white undershirt like the one he saw on the surveillance footage — he reads the kid his Miranda rights and begins grilling him about the keys. Then Englund locks him in the back of the cruiser while he runs his record.

Englund repeatedly lies throughout:
- Seeing "wide eyes" at an impossible distance
- Saying he conducted a frisk, when it was clearly a search
-Claiming the guy ran

Englund asks the guy a couple of questions that provide him with no new information, while this guy nonchalantly picks at the seal on his strawberry milk.
Then, Englund inexplicably decides to cuff and frisk him (not allowed in a Terry stop w/o a valid safety concern.

You'll have to read the story on our site to get all the details, but there is so much in Englund's account of this incident that doesn't add up. OPA politely calls it "questionable."
"Dishonest" is more accurate.
