I...don't think that's within the realm possibility. It was in federal court, and states bring and win "interstate" antitrust cases all the time without DoJ.
If it does get tossed (I doubt it, what does SCOTUS have to gain by going to bat for Ticketmaster?) I would expect it to be on some random technicality or by nerfing the remedy
