so, a few months ago, i built my own sovereign ops tool called BATOU: Bitcoin Ai Task Oriented Unit. i made it mostly for me and my family. bitcoin and nostr integrated at the foundation layer. self-hosted. local models. privacy by default.
if you recall, i also created an orchestration - hub/spoke model early on, and it's been running really well.
lately, i've seen a lot of people shipping similar projects. that's great. i won't lie. i'm a bit envious because i never deployed my work to MSGitHub. considering that MS owns the damn platform, and the shitshow that it is... i just host my own Gitea instance instead...
in some ways, i wished i shipped after i got a first working model. or when i made bigger improvements. but i didn't. i wish i opened it up to more people... but to me, it wasn't ready... more so, it was for me. my confliction hindered.
if there's a lesson... if you built it and it works: ship it.

Контракты, реституция и карманные суды.
Австрийская школа отрицает объективную стоимость — ценность определяется субъективной оценкой сторон в момент сделки. Но теория реституции Ротбарда требует, чтобы штраф соответствовал «реально переданному активу». Если стоимость субъективна, то частный суд корпорации вправе признать штраф в $10 млн за увольнение с поста легитимным «переданным титулом» — и квалифицировать уход сотрудника как мошенничество, открывая дорогу к принудительной реституции трудом.
Кто и на каком основании определяет соразмерность штрафной неустойки в контракте, если объективной стоимости не существует, а интерпретацию осуществляет суд, нанятый одной из сторон?

Как и было указано в формулировке вопроса, ценность определяется субъективной оценкой сторон в момент сделки. Соответственно, если в контракте указан размер неустойки в случае его расторжения, это означает, что на момент подписания контракт ценность его заключения была для потенциального плательщика неустойки выше, чем размер неустойки. И если указанная в контракте неустойка представляется стороннему наблюдателю абсурдно высокой, это говорит нам о том, что заключить этот договор было в тот момент соответствующей стороне прямо-таки позарез нужно. Другой вариант объяснения — подписывающая контракт сторона не ознакомилась с пунктом о неустойке или опрометчиво сочла, что это какая-то глупость, которую никто не будет всерьёз рассматривать, ключевые моменты проговорены на словах, а всё прочее — это пустое юридическое блаблабла.
Однако, раз уж в вопросе речь именно о мнении Ротбарда, то он не зря делает оговорку о реально переданном титуле собственности. Если бы работнику был выплачен аванс, а он бы ушёл с работы, не отработав оного, то штрафная санкция оправдана, и её размер можно будет рассчитывать как раз от величины аванса (скажем, неотработанная сумма плюс издержки на срочный поиск сотрудника на замену). Но если труд ещё не оплачен, то актив не передан, а значит, и штрафные санкции неуместны. Речь просто о нарушении обещания. Работодатель может попробовать продемонстрировать суду, какие издержки он понёс в результате действий сотрудника, и суд вполне может учесть эти расчёты.
Конечно, в контракте может быть пункт о том, что все разногласия разбираются в таком-то суде, который является карманным судом работодателя, о чём нанимавшемуся сотруднику на момент подписания контракта будет неведомо. Проблема, однако, в том, что суд сам по себе не занимается энфорсментом своих решений, и в отсутствие государства этим придётся заниматься самому истцу за свой счёт (да и суд ему придётся полностью посадить на зарплату, ведь вряд ли туда будут ломиться клиенты со стороны). Конечно, он может через свой карманный суд вменить сбежавшему от него работнику бешеную неустойку, а затем прислать к нему мордоворотов, чтобы принудить отработать, коль скоро тот не располагает такими средствами. Но экономика подобных действий начинает сходиться только в колониальных условиях, то есть при наличии подавляющего военного превосходства сплочённой группы колонизаторов над разрозненной массой туземцев. Непосредственно в свободном обществе, являясь его частью, такие трюки системно проворачивать не получится, слишком уж будет бросаться в глаза неправовой характер подобной организации работы. Даже если это не повлечёт неожиданных санкций со стороны действительных или потенциальных контрагентов, работодателю придётся организовывать принудительный труд в обществе со свободным трудом, где никто не станет помогать ему, скажем, ловить беглых работников. Тебе надо, ты и лови. А новые работники пойдут, пожалуй, наймутся к конкуренту.
Ну и отвечу теперь, пожалуй, прямо на заданный вопрос. Кто и на каком основании будет оценивать соразмерность неустойки? Работник будет оценивать, из своих субъективных соображений. Если заплатит добровольно, значит, всё терпимо. Если нет, то см. абзацем выше.

Panes nos sistemas operacionais de celulares são mais fáceis de serem corrigidas quando a bateria é removida.
A bateria removível evita que o usuário tenha que pagar um técnico toda vez que for trocar a bateria.
O retorno das baterias removíveis permite o retorno dos carregadores externos de bateria, que carregam baterias que estão fora dos celulares. Além disso, ter uma bateria removível permite ao usuário comprar uma bateria pra ficar de reserva, não ficando restrito apenas aos powerbanks.
O próximo passo seria criar uma norma pra modelos padronizados de bateria, que servissem a celulares de diferentes fabricantes.

When I listen to @nprofile…f4lp talking about the secure enclave, an idea comes to mind: what if the mint wasn’t managed by just one enclave, but by multiple enclaves?
Similar to #Bitcoin, where there is only one global system but anyone can run a node, maybe anyone could run an enclave. The mint would still be unique globally, but its operation would be distributed across many enclaves.
In that sense, the state of the mint could be comparable to the UTXO set in #Bitcoin shared, verifiable, and collectively maintained rather than controlled by a single entity.
I’m not very technical, so I don’t know how complex this would be to build, but I’m just thinking out loud.
