Act too soon, and the gambit fails.
Trump is going to keep uttering his demand, even as he's reasonably sure the Senate will not act (and even if they did it'd be inadequate milquetoast half-measures), and when the last possible moment for executive action to save the nation arrives, he'll act.
If I had to bet on it, I'd wager some time right around the 4th of July, but that is just my personal guess at the moment.

Trump has to be able to argue before SCOTUS in an emergency hearing that the only, the singular, the unavoidable demand for action is his to take at that exact moment in history. He has to be able to prove that the legislature cannot act as a branch of government fast enough to deal with the problem. If that rifle was actually the murder weapon, it is almost impossible that it was a pro. A shitty old rifle of a hunting caliber with a poorly mounted scope is not something that'd be used, even in a false flag situation. Any of a hundred different cheap alternatives, with a properly set up optic, and in a caliber the pro was used to could have a similar effect without introducing a poor quality setup.

Just as with Gaza where many of the residents support the murderous fighters among them, the problem of black community members who cheer on the thugs among them must be addressed. I have written before about the incredibly difficult reeducation project that is necessary for Gaza's population. I am now utterly certain that many, many black Americans require similar reeducation, if it is even possible, to de-radicalise and pacify the violent elements and their supporters.
