The EUPL is similar to AGPL, but requires the licensor to provide the source code in Article 3. Here, it really is a restriction on distribution/communication as explained in Article 5. So, you can still have an OSI-complient licence without the SAAS-loophole. 😉

Edit: EUPL is also compatible with many other licences, while maintaining its obligations on derivative works (as long as they don't clash).
