The Scottish Government has scrapped plans which could have led to parents being prosecuted for not allowing children to dress as members of the opposite sex.
Legislation to outlaw conversion therapy designed to “change or suppress” a person’s gender identity or sexuality, or their expression of them, had been expected to be introduced at Holyrood next year.
But Scottish ministers say they are now planning to rubber-stamp legislation on the issue being developed at Westminster following major criticism of their own plans.
In a consultation earlier this year, the Scottish Government made clear that parents could have been prosecuted under the ban. Restricting clothing choices or who a child associated with were among the actions that could have become criminal. The proposals raised fears within the SNP that they could prove as unpopular as Nicola Sturgeon’s gender self-ID bill, and cost support with voters ahead of crunch Holyrood elections in 2026.
It was suggested by critics that under the plans, anything that was not “affirming” of a child’s claim to be transgender would be criminalised.
