The correct input to Photoshop also produces terrible awful things.
If something producing an illegal number is illegal, then anything capable of manipulating individual bits is illegal. Someone could, in theory, write out CP in a hex editor. We don't make hex editors illegal to prevent that, we won't make photoshop illegal to prevent that, and for the same reasons, a diffusion model that can create a picture of *anything* should not be made illegal for the purposes of preventing output that could be illegal.
