Just the case of it "missing those factors" was a spycam case where a coach put a hidden camera in a locker room and they argued he didn't produce because the girls weren't acting sexually. In this case I would intuitively think this is child porn, but only a couple factors were missing. A case in 2008 was a dad who stripped his daughter and photographed her genitalia. This is also something I would think is obviously child porn, but they argued not all the criteria were met. I think if we were hosted in the US no provider would want to take a chance without a huge legal team, but I think the response would be way different if "sexual acts" were posted.
