Technically no legal problem at all. Scotland is a separate jurisdiction from England & Wales, and many laws are different, even when passed in Westminster. In fact the whole legal system is different & Westminster has to take care where they want a law to have the same effect over the whole UK to write it correctly to do so.
*Politically* yes a major problem, but it's not the judges fault if the politicians cocked it up.
