There are things one can do to avoid being tracked by their own phone. It is much harder to avoid tracking via ALPR in a country organized around driving.

There is also some amount of red tape cops need to navigate to obtain location data from a mobile carrier. Flock’s business completely sidesteps any semblance of due process - that’s a feature, not a bug.
