1/4 🚨 The EU is set to sell our most sensitive data to the US for visa-free travel 🚨
🛫 The European Commission is finalising talks with the Trump administration on the 'Enhanced Border Security Partnership' (EBSP) Framework Agreement to keep visa exemptions for EU citizens travelling to the US.
Read our analysis of the leaked EBSP framework agreement, and our call to EU leaders to resist US pressure and protect our safeguards ➡️ https://edri.org/our-work/the-eu-is-about-to-sell-our-most-sensitive-data-to-the-us-for-visa-free-travel/

More closed-door discussions with the Trump administration won’t strengthen cooperation, they will undermine trust, transparency, and in the worst case even the EU’s ability to enforce its own rules.
Together with other civil society organisations, we call on the @npub1m96…ag4y to halt this “dialogue” and focus on stronger, faster, and more transparent enforcement of Europe’s digital laws.

✊🏾 The strict enforcement of EU’s tech laws is not up for negotiation!
Yesterday, the @npub1m96…ag4y confirmed plans to open a new “formal dialogue” with the 🇺🇸 gov on EU tech law enforcement. Framed as cooperation, this could create a backdoor for Big Tech to weaken EU'slandmark rules.
The #DSA, #DMA, #AIAct & #GDPR exist to protect people, safeguard democracy & rein in Big Tech. If the Commission seeks enforcement dialogue, it should do so with the people in :europe: & public interest groups.

3/3 🚨 With the Parliament still unconvinced, four EU Commissioners decided to interfere, trying to pressure MEPs to support their mass surveillance proposal, even promoting the interests of #BigTech companies like Google, Meta and Snapchat!
Despite this blatant attempt to cow the Parliament into abandoning their position, MEPs held strong and continued to reject the mass scanning of our private communications 👏🏽

2/3 🚨 Conservatives in the Parliament pushed for a second vote after being unhappy with the original vote's outcome. Their solution: ignore democratic agreement, just vote again till they get a favourable outcome!
🚨 Earlier negotiations fell apart because EU Member States (Council) would not make any meaningful concessions to the Parliament's balanced and proportionate position. 5/5 ⛔ Maintains the Commission's proposal of eroding rigorous standards for high-risk AI systems by extending privileges to companies with up to 1700 employees, such as lower fines and lower reporting standards.
✊🏽 We are counting on the Parliament to agree on a final position that centers #FundamentalRights, and for trilogue negotiations to reinforce protections for people.

4/5 ⛔ Keeps the delay of over a year for when the high-risk AI system requirements comes into force, leaving people in the EU without protection from harms by risky AI systems.
⛔ Maintains the Commission's proposal that risks the exposure of people’s sensitive data for ‘de-biasing AI’ with very weak safeguards, despite existing legal avenues such as consent under #GDPR.

3/5 ⛔ Maintains the weakened powers of fundamental-rights bodies. They were bestowed with special oversight powers under the AI Act, but now cannot request necessary information from AI companies, and need to go through an intermediary.
⛔ Undermines the AI Act as a horizontal law without appropriate considerations for consequences, which lies far beyond the purported mandate of ‘technical changes’ of the AI Omnibus.

2/5 Specifically, the Parliament's position:
✅ *️⃣ Reintroduces the vital requirement for high-risk AI systems to register in an EU wide database, including if providers self-assess that their system is not high risk. However, it would still exclude important and readily-available information from this database, which will hinder effective oversight.

1/5 🚨 🏃🏽‍➡️Deregulation speedrun today: #AI Omnibus to undergo European Parliament plenary vote, with negotiations between EU institutions starting within hours 🚨
🙅🏽‍♀️ This ‘move fast, break things’ approach shows once again that the AI Omnibus procedure is deeply flawed.
We have been urging EU lawmakers to reject the re-opening of core #HumanRights and safety protects. Yet, the Parliament's position continues to weaken crucial parts of the #AIAct and fundamentally changes the structure of the law.

From recent leaks, a first Council compromise on the #DigitalOmnibus scrapes out some of the most dangerous changes in the original proposal…Yet, let’s not be fooled: the threat to our rights is still very real.
Even with changes, it still reduces companies’ obligations rather than strengthening accountability.

1/ 🪅 Great news!
Today, the #EuropeanParliament voted to improve the Commission’s proposal for another extension of the ePrivacy derogation (often called "Chat Control1.0").
A large majority agreed that:
✅ Mass surveillance of private communications by Big Tech companies is not allowed, and any intrusion into people’s right to confidential communications needs to be based on reasonable suspicion;
✅ End-to-end encrypted communications cannot be weakened or undermined.

2/ Under the #DSA, VLOPs must provide at least one recommender option not based on profiling.
While Youtube formally offers one, accessing is not easy. Users must navigate through multiple layers of settings, interpret technical terminology, & actively override default configurations.

2/3 On #AgeVerification, the position of EU member states is to have rules which would force most or all private message services to check people's ID documents before being able to use them.
🚫 This would not keep anyone safe, but could have serious negative consequences on everyone's free expression and right to private communications.
The Parliament needs to prioritise making sure that the final text on the #CSARegulation safeguards uses of age verification and doesn't make them mandatory.

🗣️ Transparency isn’t red tape, it’s accountability 🗣️
The #DigitalOmnibus proposes to remove Article 49(2) from the #AIAct. This would allow AI providers to dodge registration of high-risk systems by self-declaring they’re “not high risk”.

With 18 CSOs, we have sent a letter to the 🇨🇭 Federal Department of Justice & Police to oppose plans to expand its data retention regime. This proposal forces the collection & retention of people’s data across the board, dramatically widening online surveillance.

Data protection is fundamental right & backbone of many other digital rights we rely on every day.
Strong data protection limits surveillance, curbs profiling, exposes discrimination & gives people ways to challenge automated decisions. Without it, words like fairness, equality & accountability quickly lose their meaning, online & offline.
Today & any other day, our message should be clear: this right matters, it's not negotiable & deserves full protection.

The @npub1m96…ag4y has opened a #DSA investigation into X’s AI chatbot Grok.
In just days, its produced 3M+ non-consensual sexualised images of women &minors, turning X into an infrastructure for AI-enabled sexual abuse. Elon Musk and his company have treated the harm like a game, putting profits over people.
We welcome the EC decision: strong safeguards, independent verification, dissuasive fines, and bold EU enforcement are non-negotiable.

Today the @npub1m96…ag4y unveiled its proposal for a Digital Networks Act (#DNA)... and it has far-reaching implications for Europe’s internet.
Despite being framed as a “technical update,” our member [@epicenter_works](https://chaos.social/@epicenter_works )'s first analysis shows the proposal could dismantle key net neutrality safeguards, centralise political power, and threaten an open and neutral internet.

Today, #Australia enforced a social media ban for kids under 16.
The same debate is happening in Europe, where #AgeVerification measures are gaining traction, with the European Commission, the Council of the EU, and the European Parliament all endorsing similar approaches.
‼️ Reminder: age verification is not real protection. It’s a quick techno-fix that locks young people out of spaces while failing to address the root problems of broken platforms.

6/6 ⚠️ These are not the only issues still plaguing the law. Technically infeasible network blocking rules; unreliable scanning technologies; a creeping risk of excessive law enforcement powers over supposedly independent institutions; and many others remain.

5/6 ⚠️ Mass surveillance could present itself in two ways: 1) if the Council's preferred voluntary scanning regime is extended indefinitely, #BigTech companies could be allowed to scan the messages of users without any need for suspicion of CSAM crimes.
2) the Council also wants to make it mandatory for most or all private communications services (emails, Signal messages, WhatsApp, etc.) and app stores to use age verification or similar tools. This would have a huge chilling effect.

2025-12-10 11:14:05 UTC

4/6 ⚠️ The final text could end up being really messy and complex, with providers forced to take the heaviest possible measures to avoid being non-compliant. This sledgehammer approach could force them to make poor and counter-productive design choices, and might also lead to a de-facto obligation for so-called "voluntary" scanning and widespread #AgeVerification, despite the risk of this doing more harm than good

3/6 ⚠️ The Parliament and Council have both included strong protections for end-to-end encryption in their positions, but the European Commission and some EU Member States still seek systematic access to E2EE services through this law. Any final law must fully, expressly and equivocally uphold the integrity of E2EE services, otherwise innocent people, businesses, and even governments could be put at risk of digital security breaches

2/6 Some of the most dangerous and techno-solutionist parts of the European Commission's original proposal have thankfully been addressed by the Council of the European Union and the European Parliament. But there's still a huge amount to fix in trilogues to make sure that any eventual law is compatible with the EU's #FundamentalRights and freedoms, and an ongoing risk of several major harms…

2025-12-10 11:12:16 UTC

1/6📍#ChatControl: Yesterday, EU lawmakers entered the final stage of negotiations ('trilogues') on the controversial hashtag#CSARegulation, aka Chat Control.
📣 EDRi has been advocating for years to make sure that this law tackles the severe crime of child sexual abuse material (CSAM) online without resorting to #MassSurveillance, breaking #encryption or compelling people to undergo intrusive age checks, all of which would have harmful consequences for people and communities.

The EU is showing that powerful platforms are not above the law: they must take responsibility for the harms they inflict on users, communities & democracy.
✊🏾 And it must go further: scale up enforcement power, protect its digital rule of law, and refuse to let political or corporate actors weaken accountability. Anything less leaves our digital space vulnerable to those who profit from its erosion.

On Friday, the @npub1m96…ag4y hit X with a €120M fine for deceptive practices for violating the #DSA.
Even if the fine comes late, Musk's reaction on social media and the US government's irresponsible threats against the EU show that we're on the right path. “Why should lawmakers reject the EU’s #DigitalOmnibus?”, you might ask.
Say no more: here are 🔟 reasons.
The Omnibus is being sold as a competitiveness boost but this framing misses what’s really at stake.
These changes don’t simplify, don’t support SMEs & they don’t fix enforcement.
What they do is erode accountability, fragment protections, & shift power further toward actors already shaping Europe’s digital ecosystem.
More from @npub1z72…cfx0 for @npub17r9…w3z4
https://www.techpolicy.press/the-eus-digital-omnibus-must-be-rejected-by-lawmakers-here-is-why/

2025-12-01 08:27:57 UTC

Behind the language of “simplification” in the #DigitalOmnibus lies a fast-track to reopening and weakening the #GDPR & #eprivacy Directive, the core safeguards that protect our daily lives.
@npub1z72…cfx0 examined the amendments article by article & what it means in real life for data protection (spoiler: more data harvesting, less control)
Individually, these changes are worrying. Together, they amount to a structural weakening of Europe’s privacy framework.

⚠️ The Ombudsperson's findings on the Commission's maladministration also included those the #deregulation agenda: The Commission also did not follow proper rules for the Omnibus proposal on corporate sustainability and due diligence and on the Common Agricultural Policy.
This assessment shows serious procedural shortcuts from the EU's executive body that has clearly resulted in rushed and harmful lawmaking. The #DigitalOmnibus launched last week is a result of the same.

4/5 🚫 The Council's text also requires providers of many different online services to take steps to mitigate the risks posed by their platforms.
Sounds great in theory but providers could be forced to take measures which may create more harms such as allowing private messages (chats, emails etc.), app stores, and others deemed "risky" to use age verification or assessment tools. This can undermine hashtag#privacy and pose a major chilling effect on people's freedoms.

2025-11-26 13:15:10 UTC

- reply

3/5 🚫 The Council's version still allows so-called "voluntary" detection. This means that Big Tech companies can decide to scan your personal messages, without suspicion that you're doing anything wrong, and apply error-prone predictive AI tools to look for evidence of abuse. This sort of scanning already happens, with very little transparency and and oversight, and no proper legal basis.

2025-11-26 13:13:56 UTC

2/4 🤔 What does it mean going forward?
✅ The European Parliament's position also rules our forced mass scanning and protects encrypted communications. With the Council's position also reiterating this, it's likely that the final deal on #CSAR will not undermine the confidentiality and integrity of the people of Europe's secure encrypted chats with friends, families, doctors, lawyers and more.
The Council's press release about their position ➡️ https://www.consilium.europa.eu/en/press/press-releases/2025/11/26/child-sexual-abuse-council-reaches-position-on-law-protecting-children-from-online-abuse/

2025-11-26 13:13:28 UTC

1/5📍#ChatControl: Today, following a lot of public pressure, representatives of the EU member states have finally agreed on their position to remove arguably the most controversial part of the #CSARegulation: the requirement for message and email services to scan users' private communications.
🔑 This is a key development. We, along with hundreds of experts, have criticised this part of the law for undermining the presumption of innocence and posing an existential threat to #encryption.

2/2 In 2026, the Commission is preparing even broader expansions of Europol and Frontex powers, deepening the criminalisation of migration, solidarity, and dissent.
The fight is not over.
✊🏾 As #ProtectNotSurveil, we’re building collective resistance to stop the expansion of the EU’s digital surveillance state and to protect everyone’s rights and safety.

1/2 🚨 Today the European Parliament voted to expand Europol’s powers and funding, accelerating the growth of the EU’s digital #surveillance state.
What this means:
❌ More biometric surveillance
❌ More mass data collection
❌ More data-sharing with non-EU authorities
All pushed through under the false pretext of “fighting migrant smuggling.”
And the worst is yet to come...

What’s being presented as a “technical streamlining” is, in reality, a covert dismantling of Europe’s strongest digital safeguards.
In its current form, the Digital Omnibus would:

🔴 hollow out the GDPR ➡️ companies mark their own homework
🔴 shift power from people ➡️ to tech & state actors

Much of today’s internet exploits attention & vulnerability instead of supporting free, informed choice.
The Digital Fairness Act (DFA) can change that, by banning manipulative design & making fairness-by-design the norm.
EDRi has submitted its response to the European Commission's call for
evidence, urging:
🔴 Bans on manipulative design
🔴 Fair defaults & real consent
🔴 Behavioural design impact checks
🔴 Strong, coordinated enforcement

The @npub1m96…ag4y called out TikTok & Meta for breaking key transparency & accountability rules under the #DSA
The two tech giants made unnecessarily difficult to access data and, in Meta’s case, used deceptive interface design that confuses & discourages users from flagging illegal content.
After this preliminary decision, we urge the Commission to move swiftly toward final remedies & fines — because justice delayed is justice denied.

In a nutshell: genuine simplification should make rules clearer, enforcement stronger & justice accessible.
Simplification means:
✅ Clearer rules and stronger enforcement
✅ Strengthen protections for people, not weaken them
✅ Ensure equal access to rights for all communities, especially those most affected by technology harms.
Anything less risks rolling back years of progress, putting 500 million people at risk of privacy, equality, and security breaches.
