3/3 🚨 With the Parliament still unconvinced, four EU Commissioners decided to interfere, trying to pressure MEPs to support their mass surveillance proposal, even promoting the interests of #BigTech companies like Google, Meta and Snapchat!

2/3 🚨 Conservatives in the Parliament pushed for a second vote after being unhappy with the original vote's outcome. Their solution: ignore democratic agreement, just vote again till they get a favourable outcome!

2/ 🤔 This law was only ever meant to be temporary because of the serious limitation it puts on the right to privacy in Europe - but it's now well into its fifth year. The Parliament has at least reduced this new extension by 8 months compared to the Commission’s proposal.
Final negotiations are starting this week, the Council did not amend the Commission’s text in their position.

Today, the #EuropeanParliament voted to improve the Commission’s proposal for another extension of the ePrivacy derogation (often called "Chat Control1.0").
A large majority agreed that:
✅ Mass surveillance of private communications by Big Tech companies is not allowed, and any intrusion into people’s right to confidential communications needs to be based on reasonable suspicion;
✅ End-to-end encrypted communications cannot be weakened or undermined.

Today, a Dutch judge ruled in favour of EDRi member @npub1vuw…gshh of Freedom in the appeal vs. Meta.
Facebook and Instagram users will be free to choose how information appears in their feed - and not be forced into algorithmic timelines - will remain intact.
But the fight isn’t over as Meta is still ignoring these rules in other European countries.

While Youtube formally offers one, accessing is not easy. Users must navigate through multiple layers of settings, interpret technical terminology, & actively override default configurations.

2/3 On #AgeVerification, the position of EU member states is to have rules which would force most or all private message services to check people's ID documents before being able to use them.
🚫 This would not keep anyone safe, but could have serious negative consequences on everyone's free expression and right to private communications.
The Parliament needs to prioritise making sure that the final text on the #CSARegulation safeguards uses of age verification and doesn't make them mandatory.

Security ≠ surveilling everyone
With 18 CSOs, we have sent a letter to the 🇨🇭 Federal Department of Justice & Police to oppose plans to expand its data retention regime. This proposal forces the collection & retention of people’s data across the board, dramatically widening online surveillance.

Today, #Australia enforced a social media ban for kids under 16.
The same debate is happening in Europe, where #AgeVerification measures are gaining traction, with the European Commission, the Council of the EU, and the European Parliament all endorsing similar approaches.

5/6 ⚠️ Mass surveillance could present itself in two ways: 1) if the Council's preferred voluntary scanning regime is extended indefinitely, #BigTech companies could be allowed to scan the messages of users without any need for suspicion of CSAM crimes.
2) the Council also wants to make it mandatory for most or all private communications services (emails, Signal messages, WhatsApp, etc.) and app stores to use age verification or similar tools. This would have a huge chilling effect.

On Friday, the @npub1m96…ag4y hit X with a €120M fine for deceptive practices for violating the #DSA.
Even if the fine comes late, Musk's reaction on social media and the US government's irresponsible threats against the EU show that we're on the right path. ⚠️ The Ombudsperson's findings on the Commission's maladministration also included those the #deregulation agenda: The Commission also did not follow proper rules for the Omnibus proposal on corporate sustainability and due diligence and on the Common Agricultural Policy.
This assessment shows serious procedural shortcuts from the EU's executive body that has clearly resulted in rushed and harmful lawmaking. The #DigitalOmnibus launched last week is a result of the same.

4/5 🚫 The Council's text also requires providers of many different online services to take steps to mitigate the risks posed by their platforms.
Sounds great in theory but providers could be forced to take measures which may create more harms such as allowing private messages (chats, emails etc.), app stores, and others deemed "risky" to use age verification or assessment tools. This can undermine hashtag#privacy and pose a major chilling effect on people's freedoms.

3/5 🚫 The Council's version still allows so-called "voluntary" detection. This means that Big Tech companies can decide to scan your personal messages, without suspicion that you're doing anything wrong, and apply error-prone predictive AI tools to look for evidence of abuse. This sort of scanning already happens, with very little transparency and and oversight, and no proper legal basis.

✅ The European Parliament's position also rules our forced mass scanning and protects encrypted communications. Amazon Web Services & Microsoft Azure may soon be brought under the scope of the #DMA. The Commission is preparing a investigation to assess whether these cloud giants should face new obligations after years of escaping DMA oversight due to technical loopholes

Much of today’s internet exploits attention & vulnerability instead of supporting free, informed choice.
The Digital Fairness Act (DFA) can change that, by banning manipulative design & making fairness-by-design the norm.
EDRi has submitted its response to the European Commission's call for
evidence, urging:
🔴 Bans on manipulative design
🔴 Fair defaults & real consent
🔴 Behavioural design impact checks
🔴 Strong, coordinated enforcement

The @npub1m96…ag4y called out TikTok & Meta for breaking key transparency & accountability rules under the #DSA
The two tech giants made unnecessarily difficult to access data and, in Meta’s case, used deceptive interface design that confuses & discourages users from flagging illegal content.
After this preliminary decision, we urge the Commission to move swiftly toward final remedies & fines — because justice delayed is justice denied.

In a nutshell: genuine simplification should make rules clearer, enforcement stronger & justice accessible.
Simplification means:
✅ Clearer rules and stronger enforcement
✅ Strengthen protections for people, not weaken them
✅ Ensure equal access to rights for all communities, especially those most affected by technology harms.
Anything less risks rolling back years of progress, putting 500 million people at risk of privacy, equality, and security breaches.

But that’s not it: the process itself is deeply flawed. Short consultation timelines, industry-dominated “reality checks,” and optimistic impact assessments leave little room for alternative views.
That’s not meaningful participation: it creates legal uncertainty and reduces scrutiny, undermining democratic oversight, while leaving room for corporate wish-lists.
