what I've heard is that it's better for the small sites cause it prevents lawsuits from even getting going against site operators. without it, most sites might win under 1A but the cost to defend yourself would be too much for little guys. the big guys have the lawyers and money to handle those cases, so they'd eventually be the only sites left.
