I'm talking about PCB netlists. I'm not sure that ASIC netlists are protectable at all (like mask works are), I'd love to see a citation for that if you have one.

As for FPGAs, that's a corner case in between software and hardware, and I wouldn't bet on legal decisions going either way or even being consistent.
