"What Lincoln did was suspend the writ of habeas corpus in certain areas. This allowed the federal authorities to hold suspects without access to the courts. He also established military commissions to hear cases against suspected seditionists, collaborators, and Confederate sympathizers.

While this regime was abused in some cases, it also allowed the federal government to crush disloyal activities quickly.

Lincoln felt the Constitution gave him the power to suspend habeas corpus, and Congress backed him up. Not until Lincoln was dead and the war was over did the Supreme Court rule that habeas corpus cannot be suspended if the normal federal courts are in operation, as they were throughout the North during the war.

Lincoln’s actions continue to stir controversy, but essentially he demonstrated that the federal government could defend itself in the interest of preserving the Union. That’s really what some people can’t forgive."
