Interesting essay and I definitely agree with a lot of the points you raised here. That said, restitution is easy for financial crimes or crimes where the violation of one's property rights can be quantified financially. How do you deal with crimes like murder, rape or kidnapping where the damage is financially irreparable and more psychological as well as personal? Like how do you punish someone who has killed a close relative or friend using the model you just described?
