Where did you get that 40% stat?
I was dealing with a race/hate crime recently. The 'follow-up' section may be of interest and is relevant, I think.

Undocumented there, young witnesses to that crime had smartphone video footage but did not report it to the police because it showed the victim fighting back. They thought the police would use that evidence against the black victim!
Particularly with race/hate crimes and the emboldening of the racists who live amongst us (being whipped up by the likes of the prime minister, no less, with 'rivers of blood' type rhetoric), I hear that black and brown people have little confidence in the police and just don't bother to report these crimes, they just 'suck it up'.
