Both "free software" (as defined by the FSF) and "open source" (as defined by the OSI) have explicit clauses that don't allow discrimination based on purpose. The FSF has "Freedom 0: The freedom to use the program for any purpose.", including commercial use. And the OSI definition includes "No discrimination between uses, including commercial use".
