Of course I wouldn’t because this kind of compassionate exemption from legal liability is also enshrined in European values. The “values” I’m talking about is a combination of high-level documents such as Fundamental Rights Charter being part of Lisbon Treaty and Constitutions of individual Member States, on which actual low-level laws and court interpretations are based.
Based on the combination of all these elements, someone who stole bread because they were hungry would be obviously exempted from legal prosecution and rather referred to social services.
At the same time an ardent supporter of a female genital mutilation on religious or traditional grounds should be probably not allowed to come into Europe in the first place, because it’s very likely they won’t stop doing that - quite the opposite, they will use legal loopholes like taking their underage female relatives out of EU to conduct the operation anyway.
